This website is operated by Sovara Living. Throughout the site, the terms “we”, “us”, and “our” refer to Sovara Living. By accessing our website and/or purchasing from us, you agree to be bound by these Terms of Service.

These Terms apply to all users of the site, including browsers, customers, vendors, and contributors of content. If you do not agree to these Terms, you may not access the website or use our services.

1. Online Store Terms

• By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or territory of residence.

• You may not use our products for any unlawful or unauthorised purpose, nor may you violate any laws in your jurisdiction.

• We reserve the right to refuse service to anyone for any reason at any time.

2. Pricing & Payment

• Currency: All prices are displayed in Australian Dollars (AUD) and include Goods and Services Tax (GST).

• Changes: Prices, promotions, and product availability are subject to change without notice. We reserve the right to discontinue any product at any time.

• Payment: Full payment is required at the time of purchase. Orders will not be dispatched or made available for collection until payment has cleared.

• Methods: We accept major credit/debit cards and supported third-party payment providers (e.g., PayPal, Afterpay, Zip).

3. Orders & Pre-Orders

Order Confirmation

Your receipt of an electronic order confirmation does not signify our acceptance of your order. We reserve the right to accept or decline your order at any time after receipt for any reason (e.g., stock errors or suspicion of fraud).

Pre-Orders

• Estimates: Estimated Time of Arrival (ETA) dates for pre-order items are estimates only provided by our suppliers and logistics partners. While we endeavor to meet these dates, delays can occur due to global shipping or manufacturing issues.

• Delays: Sovara Living is not liable for any loss or damage arising from a delay in delivery.

• Cancellation: You may cancel a pre-order for a full refund within 7 days of placement. Cancellations made after 7 days may incur a processing fee as per our Refunds & Returns Policy.

4. Products & Accuracy

Natural Variations

Many of our products feature natural materials such as marble, stone, timber, and leather. These materials have unique veins, knots, and colour variations. These are characteristics of the material, not faults. We do not refund for natural variation.

Colour Accuracy

We have made every effort to display the colours and images of our products as accurately as possible. However, we cannot guarantee that your computer monitor's display of any colour will be accurate.

5. Delivery, Access & Risk

Delivery

• Delivery times are estimates. Sovara Living is not responsible for delays caused by third-party carriers or events outside our control.

• Access: It is the customer's responsibility to ensure the furniture will fit through doorways, lifts, and hallways. If delivery is impossible due to access issues, standard return fees (shipping + restocking) will apply.

Risk of Loss

• Sovara Delivery: Risk in the goods passes to you upon delivery to your specified address.

• Customer Pickup / Own Freight: If you (or your own courier) collect goods from our warehouse, risk passes to you immediately upon collection. Sovara Living is not liable for damage that occurs during transit when you arrange your own transport.

6. Returns & Refunds

Returns, refunds, and exchanges are governed by our Refunds & Returns Policy, which is incorporated into these Terms by reference.

• Change of Mind: Accepted within 7 days (conditions apply).

• ACL: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

7. Warranty

Our products come with a 12-Month Warranty against manufacturing defects. This covers structural integrity but does not cover:

• Normal wear and tear.

• Damage caused by improper assembly, misuse, or lack of care.

• Commercial use (unless specified).

8. Intellectual Property

All content on this website—including text, images, logos, product designs, and graphics—is the property of Sovara Living or its licensors and is protected by Australian and international copyright laws. You may not reproduce, duplicate, copy, sell, or exploit any portion of the Service without express written permission.

9. Prohibited Uses

In addition to other prohibitions, you are prohibited from using the site or its content:

• (a) For any unlawful purpose;

• (b) To solicit others to perform unlawful acts;

• (c) To infringe upon our intellectual property rights;

• (d) To harass, abuse, insult, harm, or discriminate;

• (e) To submit false or misleading information;

• (f) To upload viruses or malicious code.

10. Limitation of Liability

To the extent permitted by law, Sovara Living shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind (including lost profits or revenue) arising from your use of any of the service or any products procured using the service.

• Our liability is limited to the cost of the goods purchased or the replacement of those goods, as required under the Australian Consumer Law.

11. Indemnification

You agree to indemnify and hold harmless Sovara Living and its directors, employees, and affiliates from any claim or demand, including reasonable attorneys’ fees, made by any third party due to your breach of these Terms or your violation of any law or the rights of a third party.

12. Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria.

13. Changes to Terms

We reserve the right to update, change, or replace any part of these Terms of Service by posting updates to our website. It is your responsibility to check our website periodically for changes.
